DEALERTRACK LOYALTY PROGRAM (the “Contest”) RULES AND REGULATIONS

 
THIS CONTEST IS INTENDED FOR AUTHORIZED DEALERTRACK DEALERSHIPS WITHIN CANADA AND WILL BE INTERPRETED ACCORDING TO CANADIAN LAW.

1. SPONSOR

This Contest is sponsored and administered by TRADER Corporation or its appointed designee (the “Sponsor”).

2. CONTEST PERIOD

The Contest runs from 12 a.m. Eastern Time (“ET”) on January 1, 2025 to 11:59 p.m. ET on December 31, 2025 (the “Contest Period”).

3. HOW TO ENTER & OPT OUT

All eligible Dealertrack dealerships (as detailed below) will be automatically enrolled as an “Entrant” to the Contest and segmented based on their Peer Group as defined within these Rules & Regulations. All Entrants are deemed to be bound by these Rules and Regulations.

Any Dealertrack dealership may elect to opt out of the Contest (i) at any time through a request in writing by their designated representative or (ii) after the Contest begins by having a user designated as a Dealer Information Officer manually opt out using the Dealership Details page within the Dealertrack Portal.

4. ELIGIBILITY

The Contest is open to all authorized Dealertrack dealerships within Canada, and is based on booked volume (the “Booked Volume Contest”).

To be eligible for the Booked Volume Contest you must have (i) a valid dealer agreement with Dealertrack, (ii) an existing lender relationship with Dealertrack and (iii) have booked at least (one) 1 credit application between November 1, 2023 and November 30, 2024 on Dealertrack.

Some exclusions apply, and Dealertrack reserves the right to refuse entry to the Contest to any Entrant.

This Contest is subject to all federal, provincial, and municipal laws and regulations. Void where prohibited by law. The Sponsor reserves the right to cancel or suspend this Contest in the event of any accident, or administrative or other error of any kind, or for any other reason without notice to the Entrants.

5. PEER GROUPS & PRIZES

Booked Volume Contest

The Booked Volume Contest will be both a monthly and End of Year (“EOY”) contest. Each Entrant will participate in a Peer Group that will be determined based on the Entrant’s region and size. The Sponsor reserves the right to re-segment any of the below categories in any way in which it sees fit. In the event that a re-segmentation is required, the Prizes previously awarded to each Winner will remain valid.

Monthly and End of Year standings will be posted on the Dealertrack Portal that will showcase where each Entrant ranks within their Peer Group (“Dealertrack Leaderboard”).

The number of Prizes for each Peer Group for the entire Booked Volume Contest Period are set out below:

There are a total of 48 EOY prizes (each a “EOY Prize”) and 112 Monthly 1st Prizes, 112 Monthly 2nd Prizes, and 112 Monthly 3rd Prizes available to be won for the Booked Volume Contest.

PRIZE VALUES

Each EOY Prize consists of a travel voucher from a third party valued at $4500 for 1st place, $2700 for 2nd place, and $1800 for 3rd place. Each Monthly Prize consists of a gift card from a third party valued at $150 for 1st place, $100 for 2nd place, and $50 for 3rd place.

All amounts are in Canadian dollars.

6. WINNERS & ACCEPTANCE OF PRIZES

Booked Volume Contest:

In the event of a tie between Entrants for any EOY Prize, the Dealership with the earlier submission time of the last booked deal will be declared a Winner. In the event of a tie between Entrants for a Monthly Prize, the Entrant with the higher booked volume in the most recent preceding month will be declared a Winner. In the event there is still a tie, the earlier submission time of the last booked deal will be declared a Winner. The Sponsor reserves the right to determine tie-breakers and Winners in any manner it sees fit.

Prior to being awarded an EOYPrize, Entrants selected as Winners must sign a release form acknowledging the non-responsibility of Sponsor, its affiliates and/or associates and their respective agents, employees and officers and directors with regard to any injury, accident, damage, claim, liability, loss or misfortune related to any aspects of the Contest, prize, the acceptance, use, misuse, possession and delivery of the prize, printing errors, claims based upon publicity rights, defamation or invasion of privacy, prior to being awarded the Prize.

Winners will be notified by e-mail within ten (10) days of the Determination Date. All prize taxes, if any, are the responsibility of each Winner.

The Sponsor will not be held responsible for the loss of prizes due to changes in e-mail addresses or any other circumstances leading to an invalid, erroneous or incomplete e-mail address.

The Sponsor or an appointed designee shall deliver prizes to Winners.

Claiming the EOY Prizes:

Winners of the EOY Prize must claim their prize within three (3) months of the date the winner is announced. As a condition of claiming the EOY Prize, each Winner must sign a standard waiver provided by the Sponsor. If a Winner does not sign the waiver within three (3) months of the announcement date, the Winner will be deemed to have declined the EOY Prize, and the Sponsor shall have no further obligation regarding the unclaimed EOY Prize.

7. GENERAL TERMS & CONDITIONS

Prizes must be accepted as awarded and may not be exactly as shown/described. The Sponsor, in its sole discretion, reserve the right to substitute any portion of the EOY Prize or a Monthly Prize with a prize of equivalent value. Some restrictions may apply. Prizes are non-transferable, non-refundable and have no cash value.

Each Entrant agrees to waive all rights with respect to print and broadcast publicity. By entering the Contest and accepting a prize, the Winner hereby consents to the reasonable use by the Sponsor of the Winner’s photograph, voice, likeness and/or image of the Winner (or its representative) without any further compensation for any future promotional activity. Each Entrant consents and agrees to the Sponsor’s collection and use of the information provided by the Entrant for the purpose of administering this Contest. Each Entrant agrees to be bound by these Contest Rules and Regulations.

The Sponsor reserves the right, in its sole and absolute discretion to cancel, modify or suspend the Contest for any reason. Any attempt to deliberately damage any website or portal or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. The Sponsor is not responsible for preemption, cancellation, or interruption, in whole or in part, of any Contest related programming.

The Sponsor’s determination of the Contest’s Rules & Regulations, the data underlying the Dealertrack Leaderboard, any Contest standings, and the selection of Winners is final. These determinations are made by the Sponsor in its sole and absolute discretion.
