DEALERTRACK CANADA PRIVACY POLICY

 

Trader Corporation, operating as Dealertrack Canada (“Dealertrack “) is committed to maintaining the confidentiality and protection of your Personal Information. This Privacy Policy explains how, and why Dealertrack handles and protects your Personal Information. Personal Information is any information that allows a person to be directly or indirectly identified.

 

1. CONSENT

We rely on your consent to collect, use, retain, and share your Personal Information. This Privacy Policy outlines your options, where available, to refuse or withdraw your consent.

You agree to this Privacy Policy when you apply for a product or service, use or website and otherwise interact with us. This Privacy Policy will apply:

  • when you ask to begin a relationship with us;
  • during the course of our relationship; and
  • for a period of time after the end of our relationship.

We do not collect Personal Information from individuals under the age of 14 without the parent’s express and verified consent.

 

2. WHY AND HOW WE COLLECT PERSONAL INFORMATION

Beginning and maintaining a relationship with us

We need to collect certain information about you to provide our products and services. This may include your contact information, information about whether you are eligible for our products and services and records that reflect our overall relationship with you. We may also need other information depending on the product or service we are providing.

Information We Collect from You

The information we may collect includes:
(i) Personal Information that you provide to a Dealer or a Lender when applying for financing or leasing of an asset, when evaluating an asset for purchase, or when a Dealer or a Lender uses a service provided by Dealertrack;

(ii) that is generated by a Dealer or a Lender when providing services to you through their relationship with Dealertrack. This information may include, but is not limited to name, address, telephone number and other personal contact information; credit and financial information; and if provided, your Social Insurance Number (“SIN”).

 

3. HOW WE USE YOUR PERSONAL INFORMATION

We use your Personal Information to help us deliver and manage our products and services, and to administer our business.

We may also collect and use Personal Information to:

i. To analyze user habits and market trends;
ii. For data management and data aggregation;
iii. To generate reports and hosting services on behalf of dealers and lenders; and
iv. We may also be required to use the information we collect to enforce our legal rights, or to defend against claims or other legal action.

Automated Decision

Personal Information may be used by a Lender or a Dealer to evaluate your credit worthiness and make decisions concerning you that may be based exclusively on an automated processing of your Personal Information (“Automated Decision”).

Online Advertising

We adhere to with the Digital Advertising Alliance of Canada’s (DAAC) Self-Regulatory Principles for Online Behavioral Advertising. You can learn more about the program by visiting the DAAC’s website at http://youradchoices.ca/

 

4. DISCLOSING YOUR PERSONAL INFORMATION

Your Personal Information may be disclosed to other business divisions of Trader Corporation, Dealers, Lenders, our employees, contractors, and consultants. It may also be disclosed to third-party agents or service providers (“Third Parties), who require this information to help us establish, maintain, and manage our business relationship with you, which will be governed by those Third Parties’ own privacy policies found here: link.

Assignees or successors of Dealertrack of our business or assets may collect, use, and disclose your Personal Information for similar purposes as those described in this Privacy Policy.

Your Personal Information may also be used and disclosed, if required, to comply with applicable legal and regulatory requirements. For example, we may be required to disclose some or all of your Personal Information to comply with a court order or a subpoena. Where reasonably possible, and provided we are not precluded from doing so, we will make a reasonable effort to inform you if we are ever required to disclose your Personal Information pursuant to a court order.

You agree to provide Dealertrack your Personal Information when you apply for credit financing or leasing of an asset or other service with a dealer or lender (“Dealer,” Lender”) with whom we do business. The Dealer obtains your consent (including consent to DealerTrack’s collection, use and disclosure of your personal information as described in this Privacy Policy) when you review and sign a consent document.

International Data Sharing

Your personal information may be transferred to, processed, and stored in provinces and countries other than your own where our service providers, affiliates and partners operate.

We take appropriate steps to safeguard your personal information when it is transferred internationally.

Corporate and Asset Transactions

If we sell all or substantially sell all of our business or sell or transfer all or a material part of our assets or are otherwise involved in a merger or transfer of all or a substantial part of our business, we may transfer all your Personal Information that we have collected and stored, to the party or parties involved in the transaction. We will require such providers to maintain your Personal Information confidentiality, to use it only for the purposes of the transaction and to safely destroy it once the transaction fails or when its purpose is fulfilled.

 

5. RETAINING AND DESTROYING YOUR PERSONAL INFORMATION

We retain your Personal Information only as long as we need it for the purposes, we collected it. Our Document Retention and Destruction Policy helps us determine the length of time it should be retained. The length of time will vary and depends upon the product or service, the sensitivity of the information, and the purposes for which we use it. We may retain your information after the end of your relationship with us. For example, we may continue to need your information:

  • for legal or regulatory purposes;
  • to respond to issues that may arise at a later date;
  • to support fraud prevention organizations and other risk assessments; and
  • for security purposes

When we no longer need your Personal Information for these purposes we may securely destroy, delete, or erase it. We may also convert it to an anonymous form.

 

6. EXTERNAL LINKS

Our website includes hyperlinks to external websites operated by third parties. We do not have any control over how they collect, use, or disclose Personal Information. Please read the third party’s privacy policy to learn about its information and privacy practices before you provide any personal information.

 

7. PROTECTING YOUR PERSONAL INFORMATION

Security Measures

We have internal policies and security standards to help protect our systems and your Personal information against unauthorized access and use. We retain your Personal Information only as long as we need it, and we only use it for the purposes that we explain to you. Our service providers and agents are contractually bound to keep your Personal Information confidential and must not use it for any unauthorized purpose. Our employees must also keep your Personal Information secure.

 

8. YOUR RIGHT TO ACCESS AND CORRECT YOUR PERSONAL INFORMATION

A Dealer or Lender may establish and maintain a file of your Personal Information for the purposes described above. You have the right to request access or correction to your Personal Information and can make a written request to the Dealer.

Accessing Your Personal Information

Upon request, we will give you access to the information we retain about you. If the information you want concerns any decisions we made about your product or service, we will tell you about the reasons for those decisions unless otherwise prohibited by law. If we relied on information from a third party, such as a credit bureau, to make the decision, we will, where the law allows, provide you with the name and address of that third party.

Please note that we will not be able to provide information about you from our records that contain references to other persons, is subject to legal privilege, contains confidential information proprietary to Trader, relates to an internal investigation, risk assessment or violation of law, or that cannot be disclosed for other legal reasons.

Correcting Your Personal Information

We make reasonable efforts to keep your Personal Information accurate and up to date. If your information changes, please notify us immediately so that we can make the necessary changes.

Request to Delete Personal Information

You can ask that Trader destroy, erase or make anonymous personal information when it is no longer required for the purposes for which it was collected by contacting the Privacy Officer at privacy.officer@trader.ca

Data Portability

You have the right to request and receive your Personal Information in a structured and commonly used technological format and can also request that information to be sent to another person or entity authorized by law to collect such information.

 

9. DE-IDENTIFICATION AND ANALYTICS

We may de-identify or anonymize your Personal Information by removing identifiable information such as your name, address, and date of birth to use it for serious and legitimate purposes. It may be aggregated and used for internal business purposes such as analytics and reporting, developing, improving our products and services, understanding, and predicting client needs and preferences, preventing and detecting fraud, identifying trends like purchasing patterns, fraud trends, or enhancing our marketing.
